Pete Carroll Attacks The NCAA For Having An "Agenda," Blasts It For Going "Beyond Facts"

Petey just released this "video statement":

He is "shocked" and "disappointed." He never thought it would come to "this."

He is extremely disappointed that Trogans "have to deal with this," sounding just like BP's Tony Hayward who wanted his "life back."

He still doesn't think there were any "facts" that support NCAA's findings and lies through his face saying that he was "vigilant."

He blasts the NCAA for going "beyond facts" and being influenced by "external elements."

That should really help the appeals process. LMFAO.

The Report documents inconsistent assertions by McNair.

The Report documents a lack of investigation by $C’s own compliance staff.

The Report documents a failure to monitor Bush in numerous occasions involving his car.

And Pom Pom is claiming the NCAA is going “beyond facts”… after $C has repeatedly failed to gather them or provide them?!?!?

Um, Petey? Pages 30-31 of the Report state as follows (emphasis added):
… A current NFLPA certified agent (“sports agent B”) is the chairman of a sports agency and a colleague of sports marketer A. He reported that the former head football coach [i.e., Carroll] asked sports marketer A to consider hiring football student-athletes as interns in his agency. Sports agent B reported:

“(Sports marketer A) was like, ‘yeah, here’s (the former head football coach) and the year before, he, he’s tryin’ to get me to hire, you know, three players, you know.’

“… How many players, I don’t even know, maybe he tried to get him to hire ten….but it was totally agreed upon between (the former head football coach) and (sports marketer A) that there was an itnernship program for that summer. That’s all I do know.”

At the hearing, the former head coach denied that he asked sports marketer A to hire football student-athletes as interns…

In the spring of 2005, sports marketer B contacted the associate director of athletics to determine if student-athletes would be interested in an internship with his (sports marketer B’s) agency. … The associate director of athletics confirmed that sports marketer B contacted him about employing student-athletes in paid intenrships at the agency. Ultimately, three student-athletes, including student-athlete 1 [i.e., Bush] worked as interns at the agency in the summer of 2005.

It is permissible to hire student-athletes, as long as the circumstances under which they are hired, work and are paid comport with NCAA legislation. In this instance, the circumstances under which the three student-athletes, including student-athlete 1, were hired constituted a special arrangement made through the sports marketing agency and the institution’s athletics department. Despite sports marketer B’s claim to the contrary, there is no evidence that the internship positions provided to the USC student-athletes in the summer of 2005 were solicited externally. USC student-athletes and only USC student-athletes were hired for these positions. The circumstances surrounding the hiring of these student-athletes made sports marketers A and B, as well as their agency, representatives of the institution’s athletics interests. …

I forwarded this to Donny Mac (who's on pms today)....

he needs to read the report, he’s been sitting there saying that as a bruin he thinks this is too harsh, after all it just involved one player. He clearly hasn’t read the report. Money on the other hand, disagreed and didn’t think it too hard. Anyone have a better way of informing Donny Mac?

The reason the sanctions are so harsh

is not because of what they knew or didn’t know, but on what they SHOULD have known if they really didn’t… Seriously, if you DON’T notice a player around agents or driving a brand new Range Rover, then it’s basically the same as knowing and not coming clean.

At first I thought someone from UCLA had hired a look-alike actor to play Cheatey Petey in order to make him and U$C look even worse. But I think it really is Cheatey.

How can you tell when Cheatey Petey is lying?

I wonder how all those 5 star recruits like having been lied to by a succession of coaches. First Cheatey and his people, and now Lamey.. And it’s not even as if Lamey is innocent and just walked into this mess. He’s the “assistant coach” at the heart of a lot of it.

This couldn’t happen to a finer academic institution than U$C.

They are all convinced that they got hosed, that the school will call its big brother to go beat up that bully ncaa, and they will win a huge lawsuit with ease. Then there’s the subtext about how just$c* really is all about academics.

That it is NOT just about reggie bu$t. Even if t was, there is this whole thing of them being repeat offenders. It is a strong punishment, but it is not too strong. I think they could have gtten more, but I am okay with it.

Let's see if I get this right --

sc has to hire Freeh to teach people like Reggie Bush that it’s wrong to ask an agent for a new car, for money for rims, and for even more money?

They have to hire Freeh to teach people like Bush that his parents are not allowed to take a house from an agent?

And, to teach coaches that when their running backs are clearly taking cash they have to speak up and stop it?

And, that it’s wrong to have agents in the locker room?

Reggie Bush is the victim? And, by golly, sc is going to help Reggie and all of their players like him to learn the simplest of moral lessons?

Uh, trogans, this is not happening everywhere else. Is there a reason your players and coaches are so “vulnerable” as to need someone to install both a legal compass and and NCAA GPS so that they can see and find violations?

This may be one of the lamest responses I’ve ever seen.

If I trotted this out in court to defend a client, I’d lose all credibility and my client would be severely punished for not taking responsibility for its actions and not showing an ounce of contrition.

Sue on! You will lose in the courts of justice. And, you will get killed in the courts of public opinion.

And, by the way, were you my client, I’d advise you not to appeal, to get the sanctions behind you as quickly as possible. Living in the limbo of an appeal with be living under a cloud for many years. At that time, sc will be under intense scrutiny. And, who will want to go there knowing that any moment the shoe will drop.

They are getting very bad advice. Or, maybe they aren’t. Maybe their arrogance and traditional “we own the cops” mentality makes them think they are invincible. They are not. And, they will learn that, soon enough.

One more point

The likelihood of winning on appeal? Probably not very good.

I think they will have a hard time challenging the factual findings. From what I heard and have read, the NCAA was very conservative in its findings — most seemed to be carefully anchored in the record.

sc will not be able to bring in “new facts”. It had a chance to build the record and, apparently, was not completely forthcoming. I draw this inference from the fact that the penalties were not mitigated because sc did not cooperate at a level that would lead to mitigation.

It is very hard to overcome findings of fact on an appeal. Appeals courts defer to the people who heard and saw the actual evidence. They would have to say that no reasonable fact finder could have reached the conclusions the committee reached. Interestingly, it was a well credentialed committee that had more than one lawyer and law professor in its ranks. I don’t see a court messing with the factual findings.

sc’s seems to be rooting its claims in an argument that the penalty was “excessive”. The problem it faces here is that the NCAA standard states that the standard of review requires that a court find that the panel “abused its discretion” in making its findings and setting the penalty. The “abuse of discretion” standard is, like most law, amorphous. But, it connotes a “higher” standard of review — one that is very difficult to satisfy.

I dont’ know that any of the trogans actually believe that they will win the appeal. If they had any power, I thought it was against a toothless NCAA BEFORE it made its findings. I actually think that “influence” tempered the penalty some.

(Unlike most around here, I do not think the trogans were hit all that hard. And, I think that will make their appeal weaker. For purposes of an appeal, they would have been better off with a death penalty.)

But, I have a hard time believing that any appeals panel, be it administrative within the NCAA or a court will feel that influence after today. Why should it? As much as sc thinks it is important, there is no constituency out there that is vested in protecting sc’s approach to sports. And, without that nationwide political pressure, what little influence sc may wield in getting players off when charged with local crimes will not do it much good in this bigger case.

The burden of proving an “abuse of discretion” will be on the trogans. Those of us who have faced that standard on appeal know it is very difficult to approve.

The NCAA has taken a stand. I’m sure it was tough to take. They socked the bully in the eye and made him cry. I don’t think they are afraid any more. And, the way sc is whining and posturing now, is not going to scare them. The bully is no longer intimidating.

What he is really saying: “I’m glad I left SC before the hammer dropped. I knew everything wrong that was going on within the program and i’m glad i got to win lots of games with complete disregard for playing fairly.”

Cheat On Pete

Christmas in June: UCLA wins NCAA #106, UCLA is hosting the super-regionals this weekend & SC gets a 2 year bowl ban & 30 scholarships. So for all those Rick Neuheisel haters out there calling him a cheater & all that other BS, they need to take a hard look in the mirror- when you point fingers you ALWAYS have 3 pointing back.

Recruiting is the key to successful football programs & this does hurt no matter what Lane Kiffin says- GOOD, but maybe if Heritage Hall had cooperated earlier this punishment would not be coming down on his watch & on his kids. I have no love for SC, but individuals should be held accountable first. The NCAA is bulldozing by NOT doing that. So in Seattle, Pete Carroll is sitting in the lap of luxury tonight with all his millions and the legacy he left behind is falling apart not even a year after he left. He takes no hits here but the program he left behind is. GOOD, I’ll take it. Cheat On Pete.

GOT 106? UCLA, LEGENDS MADE HERE. NO DOUBTS, NO EXCUSES, NO MERCY.
