Ok here are the mockups that kdblows came up with. Im not going to say anything but just show them to you and let you decide and comment.

Once we get a sense what people think, then we will start taking orders.  That will be through dumpdorrell.com.  We will have a limited edition of 500 shirts so that we can get them to your door before the OSU game.   They will be 100% cotton, come in these three colors below and probably be $16 to your door.  

The online petition is coming next, hopefully we will have that up tomorrow to viral the heck out of.  Dan Guerrero will hear from thousands!

Here are the 3 designs to choose from:

Ok, this is tough getting 300 words in. I might have to take a post from my site to be able to post this.

We need a new coach!  Get the word out.  Email this post to your friends (email link at the bottom of this post), put this post or this list on your Facebook, Myspace, or website pages.  Email sportswriters, the Daily Bruin, and the administration.      

The Lose Lavin movement helped in finally convincing the administration to act and now we have Ben Howland and a program firmly rooted in UCLA excellence.  We are not far from getting the same done with football too.  We have already seen an affect on the local media.  Before there was the internet, we had to hope the local papers would hear us or publish our letter to the editor to be heard.  Now we don't need any intermediaries. We have the internet, straight to the people. Spread the word!  Go Bruins!!!

Put a URL on it
It's important to include either DumpDorrell.com, which is memorable, or BruinsNation.com, which gets around the UCLA issue (I don't think Bruins is trademarked). Think about it: You see all these shirts walking into the RB but where are you going to go for more information? Besides, it lends further credibility to the organized effort to save our football program.

As for the petitions, it would be helpful to include a PDF version online that we all can print out, make copies and take to the game. If someone will send me the text, I can turn it into a PDF and return it to you.

It would be much more effective if you add BruinsNation.com somewhere...Isn't the point of the shirt to spread the message.

I believe is trademarked, if you check the US PTO.  However, a good argument could be made for protection under fair use.

the trouble is
if UCLA wants to send lawyers after us they will, and that would cost us a ton of money we dont want to risk, it doesn't matter if they are wrong or right.  I worked in Ackerman in Bearwear when I was a student and we had Bruin shirts, so someone has a copyright. Why risk it? If there is an IP lawyer in the house ...

Save Football was Menelaus' suggestion (Im not going to give my opinion here on any of these designs) because it is a call to arms and it makes people wonder what?!? And they will look. And its positive, before we say Dump Dorrell, which you know isn't positive to some people, ha.

As I mentioned in a thread below, and again, I am not giving legal advice here and urge you to contact IP counsel before making a decision, but it's not a copyright issue.  People can't copyright a word.

If anything, it's a trademark issue, and a simple search can tell you whether or not "Bruin" is trademark.  It appears as though "Bruin" standing alone is trademarked by the Boston Bruins, and that UCLA has "UCLA Bruins" (but not Bruins standing alone).

yes, trademark is what we meant. Trademark law doesn't require that the exact mark be used to file a suit.  UCLA lawyers could make the case that since we put 'football' together with 'Bruin' the public can be confused by that and think the shirt is a University product.  I dont want to be the one UCLA lawyers goes after. They don't need to the law to be on their side. They can use the legal system to make it too expensive for us to continue.  That's the bottom line.

actually here is a fuller explanation
a trademark only refers to the registration of a mark with the USPTO. One can assert 'copyright' protection of a mark without having registered the mark with the USPTO.  IP law protects "first use" in commerce, which is essentially copyrights.  UCLA has long used 'Bruin' and 'Bruins' on tshirts and can assert copyright violations even though they may not have registered those marks with the USPTO.  

It would be great to use 'Bruin' or 'Bruins' but who wants to take the risk with legal fees?? Step forward.

Your analysis is somewhat correct, but your terminology is not.

It is not a copyright violation.  Just trust me.  It's not.

What your referring to is that UCLA may have some common law trademark rights in marks it has long used in commerce that haven't been registered in the USPTO.

That said, I agree it's probably not worth the trouble/expense of dealing with the issue, and is best avoided in the manner you suggest.

yes, you're right. Common law trademark is what I was referring to.  Its been a long time since I dealt with copyright/trademark issues and though I know I have the spirit of the law and concepts right, the terminology gets jumbled. Thanks for clearing that up.

I'm still pretty convinced that you would have a good fair use argument anyway (and to also reiterate M, my advice here does not constitute actual legal advice or a legal relationship), especially if you made it clear that the use of the word Bruin would not create any confusion with anything that UCLA (or more accurately, the Regents of California) would do.

I would definitely buy an "A" t-shirt in true blue, I might buy a "C" t-shirt, and I wouldn't buy a "B" t-shirt.  It would be cool if we could figure out how to make shirt A more specific (ie Bruin Football) without violating copyright, but if not I still think "Save Football" is effective.  The fact that it's so general and universal makes it funny.

Re. copy right issues I am not a copy right attorney but seems like the words "Bruin" or "Bruins" are fair game because they are nicknames of other high schools and a well known professional hockey team.

UCLA Trademarks & Licensing Department
I spoke to Cynthia Holmes, Director of UCLA Trademarks & Licensing. She said that they do not have Trademarks on "Bruin(s)", and making a public statement by wearing the shirt wouldn't be the problem. The issue arises when you actually sell the shirt. She said the University could create problems for the person selling them.

Colors
I think the shirt color itself should not be blue or gold.  The reason is because if you want a bunch of people to wear these and it to be obvious, they should definitely stick out (like in a group of students in the stands).  Orange maybe?

I like the idea of blue and gold.  It emphasises that the people wearing them are fans, who support the program, and wan't what's best for UCLA football.  Given the logo, I don't think anyone will have any trouble getting noticed, and I prefer staying positive.  Just my opinion.

Ok. We are adding DumpDorrell.com
on the back of the tshirt, same lettering and all. So the tshirts will be $17 to your door. DD will be the central organizing place for the effort to get rid of Dorrell and get new football coach.  We seriously don't want to do this for another year, or worse, longer. It takes a lot of effort.  We want to be able to shut the site down for good and just become BN members.  This season, these next many weeks, is everyone's best shot at getting Dorrell dumped. Next year it will be harder.  We need to really get the message out!

Once the t-shirt is done
see if you guys can do up a .jpg or .gif file of blogad style ad.  

we will see if we can get it up on our left or right column (when it the mathematical possiblity of KD going 8-4 in the reg. season with a victory over Southern Cal is gone).

Results
Although A is the clear favorite there are enough people that want B that we will make some of those as well.  The total number of shirts will be more, but less of each. We will confirm tomorrow.

Gold shirts
What about a gold shirt with blue lettering? This would definitley get more notice and stick out in the crowd, while still showing Bruin colors. Either way, we definitely need to stick with only blue and gold.
